Software End License User Agreement
Use this software only if you agree to the following terms and conditions:
This software is protected by United States Copyright Law and by international treaty provisions.
You may use the software, but title to the software is retained by Hilgraeve.
All rights not specifically granted in this agreement are reserved by Hilgraeve
LICENSE
You may use this software on one computer at a time. This software is “in use” when it is loaded into RAM or installed on local permanent storage (e.g. hard disk, CD-ROM, etc.). You may copy this software for backup purposes only in support of such use. Each licensed copy of this software has a unique serial number.
Simultaneous use of a single licensed copy on two or more computers for purposes of communications among those computers constitutes a violation of this agreement. If you need another copy of the software for this purpose, please call Hilgraeve Customer Service at 734-243-0576.
If this software is installed on the hard disk or other storage device of a computer (other than a network server) and you use that computer the majority of the time it is in use, then you may also use this same licensed copy on your personal notebook computer, provided the software is never simultaneously in use on both computers.
If you have multiple Licenses, then at any time, you may have as many copies of this software in use as you have Licenses. The software is not “in use” when installed on a network server for the sole purpose of distribution to other computers. If the anticipated number of users of this software will exceed the number of applicable Licenses, then you must have a reasonable mechanism or process in place to ensure that the number of persons using this software does not exceed the number of Licenses.
You may transfer ownership to another party only if the other party agrees to the terms of this agreement. Temporary transfer of ownership is specifically prohibited by this agreement. If you transfer the software, you must at the same time transfer any manual or media you may have received, and transfer or destroy all backup copies.
WARRANTY
If this product does not perform in accordance with the claims and representations of Hilgraeve or if the media or documentation supplied with this product are not free from defects in materials or workmanship, and you contact our customer service department within 60 days of purchase as evidenced by a copy of your receipt, we will arrange a refund (the actual price paid for the software license, exclusive of shipping). Do not return any product until you have called Hilgraeve Customer Service (734-243-0576) and received a return authorization number.
Hilgraeve specifically disclaims all other warranties, expressed or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. In no event shall Hilgraeve be liable for any loss of profit or any other commercial damage, including but not limited to special, incidental, consequential, or other damages.
This warranty gives you specific legal rights and you may also have other rights, which vary from state to state. Some states do not allow exclusion of incidental or consequential damages, or the limitation on how long an implied warranty lasts, so some of the above may not apply to you.
This agreement shall be construed, interpreted, and governed by the laws of the State of Michigan. Use, duplication, or disclosure by the U.S. Government of the software or documentation in this package is subject to the restricted rights applicable to commercial computer software (under DFARS 52.227-7013).
